Vodafone Uncertain on “Fair Use” Contract Clause
After the extreme controversy surrounding its “fair use” clause, Vodafone has retracted its decision to increase charges for excess usage.
On Monday Vodafone announced that it was dropping its fair use clause to be replaced with a mandatory charge for users
who crossed the 500 MB mobile broadband download limit. The proposed charge would have seen customers charged 50 pence for the first 25 MB over the 500 MB limit and £2 per MB thereafter.
The provider explained that the increased charge was intended to protect the network from data abuse.
After severe criticism from customers, Vodafone made a U-turn on the decision and said that fair use would remain unchanged, at least for the next few months.
Customers were unhappy for several reasons. Mainly, users criticised the provider for not giving the usual 30-day notice to inform them of the change.
Defending the decision to drop the clause, Vodafone’s head of web relations, Jakub Hrabovsky, said: “You'll be entitled to end your contract if you can show that the introduction of the new charges has increased your total call and usage charges by more than 10 per cent.”
Instead, users who do exceed the limit would receive notifications advising them of options to move to other plans. Users will only be charged if they continue exceeding their limits.
The providers also claimed that it was highly unlikely that users would exceed the 500 MB data cap, which is a considerable volume of data. Users however appear to feel betrayed by Vodafone’s initial decision, and would welcome the retraction.
